As a trial lawyer, Tom knows that cases are won and lost on details. He works hard to dig for facts that may not be readily available and then develop those facts into a winning strategy for his clients. His end goal is to help his clients succeed in their businesses by protecting and defending their market space.
Tom specializes in all aspects
of intellectual property litigation, including patent, trademark, trade secret and copyright litigation. He has successfully litigated patent cases from sophisticated turf care equipment, e-commerce patents, and medical devices to adjustable dumbbells, construction tools, and retractable screen doors.
Tom is also experienced in handling strategies involving U.S. Patent and Trademark Office practice, such as inter partes reviews (IPRs) and ex-partes reexaminations, and weaving those into a litigation strategy. He has worked on IPRs for clients such as Medtronic, The Toro Co., Coalition for Affordable Drugs, and Dri-Steem, among others.
He has conducted a trial before the Patent Trial and Appeal Board (PTAB)—representing both challengers and patent owners—and has prepared an appeal brief to the Federal Circuit in an IPR proceeding. Tom also has experience in practicing before the International Trade Commission.
At Merchant & Gould, Tom is responsible for litigation training. He has done pro bono housing work on behalf of the Volunteer Lawyers Network. In his free time, Tom enjoy being active outdoors, including hiking, fishing, riding motorcycles, ATVs and snowmobiles, and downhill and water skiing.
